1. Acceptance of Terms
By downloading or using DMV Ace you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not download or use the app. The most current version of these Terms is always available at dmvaceapp.com/terms. Your continued use of the app after any changes constitutes your acceptance of the updated Terms.
2. About the App
DMV Ace is an independent study tool designed to help users prepare for DMV written permit tests. DMV Ace is NOT affiliated with, endorsed by, or connected to any DMV, Department of Motor Vehicles, or government agency. Practice questions are based on publicly available state DMV handbooks and are provided for educational purposes only. Passing a practice test within the app does not guarantee passing the real DMV test. Always refer to your official state DMV handbook as the authoritative source.
3. Permitted Use
You may use the app for personal, non-commercial study purposes only. You may not:
- Copy, distribute, or resell app content or practice questions
- Reverse engineer or decompile any part of the app
- Use the app or its content to create a competing product or service
- Scrape, harvest, or automate access to any content within the app
- Attempt to access systems, servers, or data beyond your authorization
4. Subscriptions and Billing
DMV Ace offers optional Pro subscriptions that unlock premium features. Current pricing (subject to change; always confirm current pricing in the app):
- Weekly: $2.99/week
- Monthly: $6.99/month
- 3 Months: $14.99 (includes free trial — see Section 5)
- Lifetime: $49.99 one-time purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time:
- iOS: Settings → [Your Name] → Subscriptions → DMV Ace → Cancel Subscription
- Android: Google Play → tap your profile icon → Payments & subscriptions → Subscriptions → DMV Ace → Cancel
Cancellation takes effect at the end of the current paid period. You will retain Pro access until that date. Cancelling does not entitle you to a refund for any unused portion of a paid period.
5. Free Trial
The 3-month plan includes a free trial period. You will not be charged during the trial. To avoid being charged, you must cancel before the free trial period ends. Only one free trial is available per Apple ID or Google account. If you have previously used a free trial for DMV Ace, you will not be eligible for another.
6. Refund Policy
All purchases are processed by the Apple App Store or Google Play. Refunds are handled entirely by Apple or Google in accordance with their respective refund policies. We are not able to process refunds directly. To request a refund:

7. Intellectual Property
All app content — including practice questions, answer explanations, UI design, branding, and copy — is owned by DMV Ace or its licensors and is protected by applicable intellectual property laws. Question content is derived from publicly available government DMV handbooks and is used for educational purposes. You may not reproduce, distribute, modify, or create derivative works from any app content without our express written permission.
8. Disclaimer of Warranties
The app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The app will be error-free, uninterrupted, or free of harmful components
- Practice questions will exactly match the content or format of your real DMV test
- Use of the app will result in passing your DMV test
DMV test content varies by state and is updated periodically. Always refer to your official state DMV handbook as the definitive source of test preparation material.
9. Limitation of Liability
To the maximum extent permitted by applicable law, DMV Ace and its owners, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the app, including but not limited to failing a DMV test, loss of study data, or loss of revenue. Our total cumulative liability to you for any claims arising from or related to these Terms or the app shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or the app that cannot be resolved informally shall be resolved through final and binding arbitration on an individual basis, rather than in court, except where prohibited by applicable law. You waive the right to participate in any class action or representative proceeding.
11. Apple App Store — Additional Terms (Licensed Application End User License Agreement)
The following additional terms apply to your use of DMV Ace if you downloaded the app from the Apple App Store. These provisions are required by Apple Inc. ("Apple") and supplement, and where applicable supersede, the rest of these Terms with respect to your use of the app on Apple-branded products.
- Acknowledgement. These Terms are concluded between you and DMV Ace only, and not with Apple. DMV Ace, not Apple, is solely responsible for the app and the content thereof.
- Scope of License. The license granted to you for the app is limited to a non-transferable license to use the app on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
- Maintenance and Support. DMV Ace is solely responsible for providing any maintenance and support services with respect to the app, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
- Warranty. DMV Ace is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (if any); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be DMV Ace's sole responsibility.
- Product Claims. DMV Ace, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of the HealthKit or HomeKit frameworks (not applicable to this app).
- Intellectual Property Rights. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, DMV Ace, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
- Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer Name and Address. Any questions, complaints, or claims with respect to the app should be directed to DMV Ace at support@dmvaceapp.com.
- Third-Party Terms of Agreement. You must comply with any applicable third-party terms of agreement when using the app.
- Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
12. Changes to Terms
We may update these Terms at any time. When we make material changes, we will notify you via an in-app notice or other reasonable means and update the "last updated" date above. Your continued use of the app after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the app.
